Gillian Shearer just released her book entitled, the Law and Practice of Workplace Investigations. The book analyzes the various aspects of an investigation, outlining employer duties, consequences of errors, rules of conduct, and investigative techniques. It also explores relevant legal issues like statutory obligations, natural justice requirements, privilege and negligent investigation.
With recent legislative changes and increased public attention on the issue of workplace harassment the standard to be applied to workplace investigations will no doubt be elevated. As such, it is all the more important to ensure that workplace investigations are conducted appropriately.
